PKLA UPDDATES  MARCH 11 2009


HB 3031 has been filed!

 Representative Keffer filed HB 3031 after negotiations between BRA and PKLA.

The PKLA survey that was sent to membership last week questioned how a 50’ set back would affect your lease.  Thank you for your responses.  Results indicate 75% of those responding found a 50’ set back to be problematic for any future construction, etc. The 50’ set back language has been removed from HB 3031.

A FERC application by the BRA requesting the removal of the buffer zone in front of residential leases was filed Friday, March 6th.  The title and first paragraph of the application reads as follows:

BRAZOS RIVER AUTHORITY’S APPLICATION

FOR CHANGE OF PROJECT BOUNDARY

 

            Brazos River Authority (“Brazos”), licensee of the Morris Sheppard Dam Project No. 1490 (“Possum Kingdom” or “Project”), hereby applies to the Commission for authorization to change the existing boundary of the Project to remove approximately 335 acres of “buffer strip” land from the Project and, as mitigation for such removal, add to the Project approximately 930 acres of land currently owned by Brazos for use by the general public for recreation and access to the Project’s reservoir (Possum Kingdom Lake).  As discussed below, the proposed change to the boundary is in the public interest, since it will not adversely impact Project resources, will result in a significant increase in the amount of land available for a high quality recreational experience by the general public, will substantially reduce Brazos’ administrative burden, and should not result in any adverse environmental impacts.

In the Catagory selection, only the Submitted block should be checked
Change the date to 3/06/09.
Under Library, Check only "Hydro" and then submitt
On the new screen, pull down to P-1490-049 and click files
On the new screen select the PDF file by BRA and then the download button
Click yes on the option to download and select the option to save ( make sure you record where the file is saved)

Close this portion and open the file in the saved folder to view.

A tax case appeal has been filed in Eastland Court of Appeals and is awaiting ruling from that court.
