HB 3031 has been filed!
Representative Keffer filed HB 3031 after negotiations between BRA and PKLA in Austin. The Bill follows the Request for Bid which will allow BRA to sell to a 3rd party. HB 3031 can be read from the House web-site at http://www.capitol.state.tx.us/ Simply go to the web-page and type in the Bill number (HB3031) or (Click Here). Some of the components of the Bill are:
· A 25’ set back for the buffer zone will remain in place. The survey that was sent to membership by e-mail questioned how a 50’ set back would affect your lease. Thank you for your responses. Results indicate 75% of those responding found a 50’ set back to be problematic for any future construction, etc.
· A floor of 50% of Palo Pinto 08’ Appraised land value was placed on Bid request.
· If a bid is awarded then the leases would be sold at 65 % of 08’ PPCAD land values.
· The financing options remained the same as found in the Bid Request except for homestead/65yr older. A 20 year lease option with a rental rate determined by BRA lease rate methodology and CPI increases or decreases will be offered to homestead/65yr leaseholders.
· The Bill will allow a lot-by-lot sale of leases if no 3rd party bid is accepted.
HB 3031 will be assigned to committee for hearing review. Last session our Divestiture Bill was assigned to Natural Resource committee. Once the committee hears and approves HB 3031 then the Bill is voted on by the House. The House will then pass the Bill to the Senate. Please keeping mind that any Bill can change as it passes through the process.

FERC application requesting the removal of
the buffer zone
in front of residential leases was filed Friday, March 6th. The
application
The title of the application reads as: Brazos River Authority’s
Application for
Change of Project Boundary. The request, if approved, will allow
leaseholders
to purchase their land to the 1000”. No timelines are available for
receiving a
ruling on this application.

Tax case appeal has been filed in Eastland Court of Appeals and is awaiting ruling.
