POSSUM KINGDOM LAKE ASSOCIATION

BACKGROUND
In
1971 the Association was formed as a non-profit organization by people
who were
dedicated to the preservation of our lake. The Association name
and
Association mission statement have changed with time to align with
community
needs. The revisions were made to define a community organization
with an
active interest in the concerns of the PK community and with the
identities
that serve the community. Membership is open to all interested in
joining
with others to cause a significant increase in community presence to
address
common concerns and coordinated community involvement.
MISSION STATEMENT
The
Possum Kingdom Lake Association is organized as a group to protect the
lake's
environment and bring people together as a community of shared interest
or
need. Possum Kingdom Lake Association will build awareness of shared
needs
through promotion and outreach by providing forums for community
involvement
with a priority of protecting the lake's resources and lake community.

Report on Divestiture by Nicole
Castro, lawyer in Austin hired by the BRA
SURVEYS
She reported that the surveys on the roads were not complete because
they had to go back and resurvey many roads in an effort to give the
county a wider easement. They are hopeful that all the surveys
will be complete by the first of next week. This is important for
closing because lot surveys cannot be completed if there is a road that
is connected to the lot. Surveys need to have all the "points" to
complete their paperwork on each lot. Ms. Castro said that after the
boundaries are established then each individual survey must match the
master survey and be approved. They expect to receive the draft
of the final survey around May 1, 2010.
ENCROACHMENTS
She also reported that with the completion of the surveys, there are
encroachments that have been identified. There are two kinds of
encroachments:
1. Lot by lot encroachments-This is were neighbors
need to work out a "new boundary line"
2. FERC encroachments-Something is found within the
the FERC buffer area.
Ms. Castro said that both BRA and Patterson will send out letters to
leaseholders identifying the FERC encroachments.
Lessees
will then have the opportunity to submit evidence that
improvements existed before the May 15, 1980 Amendment to the FERC
License or
that the improvements were approved.
BRA will then submit an application to FERC on
or before
January 2, 2012 to request approval for certain encroachments to remain
in
place and
to
document pre-1980 improvements.
If FERC does not consent to encroachments,
they will have to be modified or removed. (Note: Additional information
detailing "FERC Curative Work" is presented in the Patterson Resale
Contract on page 7 in paragraph 9.C. SURVEY).
PATTERSON RESALE CONTRACT
Patterson has received 906 signed Resale Contracts that account
for 59 percent of the BRA leases. Ninety-three percent of these
leaseholders requested contemporaneously closing and 85
percent chose preferred lender financing.

PK Tax Lawsuit was heard in Eastland Appeals Court. There is
no timeline for a ruling in the case.

Costello Island residential lease
agreement was approved with a
timeline that will allow them two years to correct septic issues on the
Island. The leased properties will be transferred to Patterson,
but the leaseholders cannot purchase the property from Patterson until
the septic systems issues are fixed. Many of the structures on
the Island have been there
since the 50's and no one realized that some of the lateral lines are
close to the 1000' lake line. Costello has agreed to hire an
expert to look into modernizing the septic systems.

Termination of Palo Pinto Stipend for
law enforcement was approved
by the BRA Board. Kent Rindy advised Palo Pinto Judge Smiddy and
Sheriff Mercer that BRA will pull back from full time law enforcement
and focus on lake issues,protection of the dam and BRA properties.
